Balderton Parish Council

Minutes of an extraordinary meeting of the Parish Council held in the Council Hall on Wednesday February 15th 2006 at 6.00pm.

PRESENT: Councillors Colman (Chairman), Allsopp, Mrs Brooks, Gibson, Mortimore, Mrs Newstead, Miss Oram, Mrs Scott, Scott, Sheppard, Miss Watson and White with three parishioners and the Clerk.

APOLOGIES: were accepted from Cllrs Ms Atkinson, Brooks, Fletcher, Hind, Jarvis and Mrs Walker, and County Councillors Mrs Saddington and Walker.

DECLARATIONS OF INTEREST none were made

2335 New Community Hall/Sports Pavilion
The chairman explained that he had called the meeting to consider a recommendation from
the Pavilion sub committee regarding the choice of contractor for the new building on the
Playing Field.

The sub committee Chairman Cllr White advised that in accordance with ‘Design and
Build’ practice the contractors have submitted their proposals and plans which sub
committee members have reviewed. The sub committee had made their recommendation
on the grounds of best value, locality and confidence in the company. It was unanimously,

AGREED that in accordance with Council Financial Regulation 11c Standing
Orders be waived to negotiate the contract with Beckside Buildings
and Installations Ltd without further competition, and approval be
given to the Chairman and Clerk to sign the contract.

The meeting closed at approximately 6.10pm

Minutes of the Amenities Committee meeting held in the Council Hall on Wednesday February 15th 2006 at 6.10 pm

PRESENT: Councillors White (Chairman), Allsopp, Colman, Gibson, Mortimore, Mrs Newstead, Mrs Scott, Scott, Sheppard and Miss Watson with Cllr Mrs Brooks, Miss Oram, three members of the public and the Clerk.

APOLOGIES: were received from Cllrs Ms Atkinson, Hind and Jarvis and Head Groundsman Mr Stevens and Mr Lecutier (Pavilion sub committee).

1260 DECLARATIONS OF INTEREST: Cllrs Allsopp and Mrs Newstead both declared a personal interest to minute reference 1257 - allotments.

The meeting was closed to take public comments. Two parishioners spoke about issues relating to the closure of the Playing Field middle gate and the new Community Hall/Sporting Pavilion. They were thanked for their comments and the meeting re-opened at 6.20pm.

1261 Clerk/Chairman’s Update
A printed update of ongoing matters was circulated and noted. The update is published with the minutes. No issues were discussed from the update.


1262 Planning Applications The following applications which members of the Planning Committee had also reviewed earlier were considered and approved subject to any details below:

The following application was considered and refused with the comments detailed below:

0024 Continue use of B8 storage and distribution Sunnyside, Barnby Road
The application is being made on the grounds of continued operation for the past ten years,
but the former coal merchant’s site was not used as a business between 1993 and 2003 when
it was sold as a residential property only. Concerns were also raised about business activity
there in general (including possible waste disposal) and a mobile home that is on the site.

1263 Planning Decisions

The following planning applications have received conditional approval and were noted:

2682 Display advertisement signs Builders Centre, Hawton Lane
2738 Erect 8 apartments with car parking Adjacent to 13 Barnby Crossing

1264 Community Hall/Sporting Pavilion
The Chairman advised that local resident Mr Lecutier had agreed to be co-opted onto the sub committee to help promote the new building and raise funds from local and national businesses. It is hoped that the shortfall in funding can be bridged by local contributions, and it may still prove beneficial to sell or lease the Council Hall to make up any shortfall to alleviate the burden of a loan. For this reason the internal layout of the new building can be adjusted to provide office accommodation should it prove necessary. Flexibility is required in order that adjustments can be made if needed.

Cllr Mrs Brooks left at approximately 6.30pm and the meeting was closed to meet Mr Avison, Managing Director of Beckside Buildings and Installations Ltd. He gave members an outline of his company’s history and assurance that he will do whatever possible to ensure the project is completed to everyone’s satisfaction. His company will be responsible for all planning permission, building regulations and health and safety issues. Once his company start work on the site they will not leave until the work is complete.

Mr Avison was thanked for his information and attendance and he left the meeting at approximately 6.55pm. The meeting re-opened.

1265 Lakeside Disabled Access
Members were advised that the recent alterations carried out to the barriers around the Lake had proved unsuccessful in terms of allowing all disabled wheelchair users access, particularly motorised wheelchairs. Council groundstaff who carried out the work consider that to heighten the barriers any further would make them ineffective in preventing motorcycles access. Further enquiries will be made to ascertain exact requirements regarding wheelchair access.

Cllr Mortimore left the meeting at approximately 7.15pm.

1266 Allotment Agreement
The Clerk advised that following risk assessments and recent local decisions made
regarding bonfires on the allotments, slight alterations were necessary to the allotment
tenancy agreement. The agreement should contain clauses regarding the prohibition of asbestos and liquid propane gas on the site, and any petrol stored on site should be kept in appropriate containers and stored safely. These amendments will be drafted out and submitted for future consideration.

1267 Middle Gate to Playing Field
An application has been submitted for a Modification Order for a Public Footpath for the route from Public Footpath no.1 through the middle gate to the Playing Field. A letter from the County Rights of Way Department has been received advising that it may be possible to put a clause on a route allowing it to be locked from dawn to dusk. The committee considered that any application which potentially jeopardised the Council’s right to secure the Playing Field should be objected to and re-affirmed its commitment to protecting the parish right of way along the Acacia Road access.

1268 Information/Correspondence
The following items of information/correspondence have been received and were noted:

a) An open letter from Chief Superintendent Johnson advising that anti-social issues in Balderton are being addressed under the leadership of Sgt Burch. The new police station in Newark is reported to be progressing well.

b) Notice that the Tree Preservation Order application has been confirmed for an oak tree on land at Flowserve, Hawton Lane.

c) A letter from County Councillor Mrs Saddington urging members to write their individual letters regarding use of Twitch Farm. Hollowdyke Lane as raised at the January Council meeting. This is in relation to an application for a Lawful Development Certificate for a dismantling scrap yard on the site. Mrs Saddington has asked the County Council to notify the Fernwood residents of the application to increase local awareness.

d) A request from a resident that the opening times at the playing field be more specific.
The notices have recently been adjusted to show that closing times are thirty minutes after published sunset times. Members considered that a sign should be made to show specific times for each month, based on sunset times.

e) An invitation to place a notice costing £50 in the Newark Advertiser on a Balderton Features Page. Members agreed that the notice should be placed containing details of the new Playing Field Hall inviting parishioners to view the plans.

1269 Future agenda Items

1. Cllr Allsopp asked that future discussion be given to dangerous parking and associated safety concerns at the two John Hunt Schools on London Road . The matter will be
referred to County Councillor Walker to liaise with the County Road Safety Department to see what action can be taken.
